By accessing or using Trackion ("Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you must not use the Service.
Trackion provides a software platform that enables users to monitor, analyse, and manage AI usage, costs, and activity across third-party providers.

Trackion provides data insights and automated recommendations for informational purposes only. Trackion does not provide financial, legal, or operational advice, nor does it guarantee cost savings or performance improvements. All decisions made based on the Service are solely the responsibility of the user.
Trackion integrates with third-party platforms, including but not limited to AI providers and cloud services. Trackion is not responsible for pricing, billing, or policy changes by third parties, service outages or interruptions, or accuracy or completeness of third-party data. Your use of third-party services is governed by their respective terms.
You are responsible for maintaining the confidentiality of your account and credentials, securing any API keys or integrations connected to Trackion, and all activity that occurs under your account. Trackion is not liable for any loss or damage resulting from unauthorised access due to user actions or third-party breaches.
Where Trackion is used as a proxy or intermediary for API requests, you authorise Trackion to process requests on your behalf. You remain fully responsible for all API usage and associated costs, and for ensuring compliance with third-party provider terms. Trackion does not control or limit your usage unless explicitly configured by you.
Fees are charged as specified on the platform or agreed separately. All payments are non-refundable unless required by law. You are responsible for all usage incurred under your account. Trackion reserves the right to modify pricing with reasonable notice and to suspend or terminate access for non-payment.
Trackion does not guarantee uninterrupted or error-free operation. The Service may be unavailable due to maintenance, technical issues, or third-party dependencies. Trackion is not liable for any downtime or service interruptions.
To the maximum extent permitted by law, Trackion shall not be liable for indirect, incidental, or consequential damages, loss of profits, revenue, or data, unexpected or increased AI costs, or business interruption. Trackion's total liability is limited to the amount paid by you for the Service in the preceding three (3) months.
The Service is provided on an "as is" and "as available" basis. Trackion makes no warranties regarding accuracy or completeness of data, reliability or availability, or fitness for a particular purpose.
You agree to use the Service in compliance with applicable laws, provide accurate and complete information, and not misuse or interfere with the platform. You must not reverse engineer or attempt to extract source code, use the Service for unlawful or harmful purposes, or interfere with system security or performance.
All rights, title, and interest in Trackion, including software, branding, and content, remain the property of Trackion. You are granted a limited, non-exclusive, non-transferable licence to use the Service.
Trackion may suspend or terminate your access at any time if you breach these Terms or your use poses a risk to the platform or other users. You may discontinue use of the Service at any time.
Trackion may update these Terms at any time. Continued use of the Service constitutes acceptance of any updated Terms.
Trackion may provide automated insights, recommendations, or analytics generated through algorithms or artificial intelligence. You acknowledge that these outputs may be incomplete or inaccurate, are not guaranteed to produce specific outcomes, and you are responsible for independently verifying all recommendations.
You acknowledge that AI usage costs can increase rapidly and unpredictably, Trackion does not control third-party billing systems, and you are solely responsible for monitoring and managing your usage.
Trackion may be provided in beta or early access form. During this period, features may change without notice, the Service may contain errors or bugs, and performance may not be stable. Use of the Service during this stage is at your own risk.
You agree to indemnify and hold harmless Trackion from any claims, damages, losses, or expenses arising from your use of the Service, your breach of these Terms, or your misuse of third-party integrations.
These Terms are governed by the laws of Victoria, Australia.
